Mission Statement

If you have experienced problems with bailiffs or local authorities in relation to parking and minor traffic enforcement, you've come to the right place. No matter what the problem is or how bad it seems we will have the solution. Methods for resolving the problems are outlined in the sections marked 'Protection Scheme' and 'Other Services'. Unlike our adversaries, nothing we do is illegal. We believe that honesty, knowledge and attention to detail will defeat bailiffs every time.

 

Introduction to Fair Parking's Bailiff Advice

Such is the impact that Fair Parking has made in the past few years, it has become a name that the parking enforcement industry now fears. Fair Parking understands the rules and laws better than anybody in the parking industry and that most certainly includes the British Parking Association and CIVEA (Civil Enforcement Association). Local authorities and bailiffs soon find themselves fatally exposed whenever they attempt to bend or ignore the laws unique to parking enforcement. Fair Parking also understands the parking and bailiff enforcement laws better than solicitors and barristers. Parking enforcement is a contentious issue that even if managed lawfully would stir our emotions, however it is never is handled within the laws by local authorities or bailiff companies.

It should be understood that unlike offences which require proof that at least matches 'beyond all reasonable doubt' in a criminal court and 'the balance of probabilities' in a civil court, parking and minor traffic enforcement - now the sole prerogative of 286 local authorities in England and Wales and which operates outside of magistrates courts and county courts - is governed entirely by a 'presumption of guilt', a term confirmed by the Ministry of Justice in head to head conversation with Fair Parking. Everything on this website is the result of intensive research and hard experience, sometimes in courts of law.

The Objectivity of Parking & Minor Traffic Enforcement

This £2 billion a year industry is out of control and evidence comes teeming in via the way the public is treated in sheer contempt by those in the business of enforcing and which inextricably leads to one extremely disturbing conclusion, this is not about justice, its about revenue. Nothing that exists for what is now officially known as 'Civil Parking Enforcement' makes any sense until it is realised and understood that anything which stands in the way of the objective of making money including the laws which govern Civil Parking Enforcement, is simply brushed aside by those who hold our trust. It is this systemic abuse of the public trust and without any shame which underpins the unlawful siphoning off of money which should rightfully stay where it is - in your pocket. The Role of Local Authorities

Fair Parking has been helping people fight the injustices of the bailiff enforcement of parking and other minor traffic contraventions for a number of years and has yet to come across even ONE instance where the law has not been broken by the local authorities concerned or their bailiffs. Not once.

In practically every case the default position of the local authority which has written a Penalty Charge Notice or Notice To Owner is one of arrogance, indifference, lack of knowledge, stupidity and a tendancy to cover up misdemeanours, all driven it seems by a delusory belief that they are totally correct and thus indestructible. Incredibly this has led to some local authorities quite deliberately attempting to mislead courts and being found out. However we have no evidence that being exposed even in court and then being forced to pay out thousands of pounds of taxpayer's money in costs and compensation has altered their views one iota. Local Authorities are therefore all vulnerable in court.

The Role of Bailiffs

The law means nothing to private bailiffs. Too often they do not even know the law. They are not court officers and will have no court documentation with them when they pounce, least of all a GENUINE warrant as opposed to one later and unlawfully printed in their own office. They are likely to be self employed. Bailiffs are not interested in anything you may have to say. They have endless excuses to try and make it look as if members of the public are out of order or have broken the law (parking enforcement is now decriminalised!). All they are concerned about is instantly seizing vehicles or extracting money on the spot and usually by cash only. Nor are they bothered who pays it or whether the amount demanded falls in line with those fees listed in statute. What has been created is an army of bounty hunters pretending that they are law enforcement officers literally extorting money at will.

It will come as no surprise that whatever local authorities do wrong, bailiffs and bailiff companies add much more to this illegality by way of bullying, intimidation and far worse for the simple reason they stand to gain far more by ignoring any semblance of the enforcement laws which not only exist but which are also quite clear.

London local authorities will only ever receive a maximum of £187 per ticket and those in the provinces will receive far less. Bailiffs however will claim hundreds of pounds in fees as a minimum. Four figures is quite normal, that is if they only charge fees for too often bailiffs will simply take cars as a first option and without any legal documentation or giving any consideration as to who owns the vehicle or whether that person has anything to do with the original allegation. When vehicles are sold it is not always at auction as the bailiffs claim and whatever the price the vehicle fetches, you can guarantee that in nearly all cases the owner will never see a penny from the sale. Local authorities and bailiffs are quite happy to assume the delusory practice of 'Unpaid parking tickets equals forfeiture of your vehicle'. No, you haven't misread that, though no such law has yet been passed.

The Role of The Police

Oh dear - if only we could be more complimentary and not just for the odd occasion when the police do get it right. Officially there is no role for the police in CIVIL parking enforcement matters. Police officers shouldn't be there, particularly those who have no idea about parking enforcement laws, let alone no idea that bailiffs should have warrants or what that warrant should look like. Section 6 of the Enforcement of Road Traffic Debts Order 1993 actually prevents police attendance. Unfortunately they still attend on the basis of ensuring that there is no 'breach of the peace'. If only that meant not becoming involved when bailiffs start making unlawful demands.....If only the police listened when members of the public are abused and lied to or vehicles and goods are taken without warrants or with faked warrants, because then 'civil' crosses over to being a criminal matter, solely because of misbehaviour by errant bailiffs. 

The police also still unlawfully join with bailiff companies in joint operations to stop motorists in order to introduce them to roadside bailiffs for on the spot seizure of vehicles or instant payments of civil accusations.

Fair Parking's intervention caused Greater Manchester Police to cease these unlawful joint operations in 2008 and again in 2010 for Metropolitan Police operations in north London. However the Met still bungles on in Westminster and the Kent police also join these these illegal joint ventures enabling private bailiffs to extract money for CIVIL allegations. It is inconceivable that the police simply do not know the law distinguishing civil parking from an offence, but thousands of motorists who have broken no laws suffer from the mass ignorance and police assisted seizures which is the sole purpose of these unlawful bailiff induced joint operations.

Summary

This is just a taste of what happens out there on our streets. The daily reality is far worse. Unless you know the law, you won't get your vehicle back, not unless you pay a four figure sum. There will be nobody to help you, not the DVLA, not the Traffic Enforcement Centre and least of all the local authority which employed the bailiffs.
